NON SIGNING OF THE HANDING OVER TAKING OVER (HOTO) AGREMENT IN RESPECT OF THE THE CONDOMINIUM NAMELY LA LAGUNE COMPLEX, GOLF COURSE ROAD, SECTOR 54, GURGAON INSPITE OF CLEAR GUIDELINES OF THE OFFICE OF  DISTRICT TOWN & COUNTRY PLANNER ON HANDING OVER THE COMPLEX BY THE COLONIZER WITHIN 90 DAYS WITH COMPLETE DOCUMENTATION OF HANDING OVER TAKING OVER AGREEMENT AND THE RETURN OF IBMS TOGETHER WITH INTEREST.
Respected Sir,

In the minutes of the meeting of AGRF held on 12.8.2016 Chaired by Shri P Raghavendra Rao, Additional Chief Secretary, under the “Action taken by the Department” column, you have very specifically written as under:
“OC WAS GRANTED ON 5.4.2016 AND THE LICENCEE WAS DUTY BOUND TO HANDOVER THE ADMINISTRATION OF CONDOMINIUM WITHIN 90 DAYS.  THE LICENCEE FAILED.  EVEN THE COMPLETION CERTIFICATE ALSO WAS ISSUED ON
16.6.2014”

Sir, during the subsequent meeting held on 28.9.2016 at the La Lagune complex, under the orders of the Additional Chief Secretary and the Chairman for the AGRF meeting of 12.8.2016, you had once again ordered the Colonizer to sign the HANDING OVER TAKING OVER  (HOTO) Agreement and handover the complex with all documents immediately after completing the Snag list within 30 days and return the IBMS with interest together with all the documentation.
Unfortunately no action has been taken by the Colonizer in last eleven months since the AGRF meeting held on 8.1.2016 when the Respected Deputy Commissioner and Chairman of the meeting had passed orders in our favour and the subsequent orders passed by you as mentioned above.
Kindly pass written orders to the Colonizer to complete the Snag List in next 30 days and the Handing Over Taking Over (HOTO) Agreement with all the documentation and the IBMS deposit with the interest else necessary action against the colonizer may kindly be taken.
A list of the documents required with the Handing Over Taking Over (HOTO) Agreement is enclosed herewith for your kind information.

MEETING CONDUCTED BY SHRI R S BATTH, ASSISTANT TOWN & COUNTRY PLANNER, GURGAON ON 28.9.2016 TOGETHER WITH THE REPRESENTATIVES OF BULDER ABW SUNCITY UNDER THE INSTRUCTIONS OF ADDITIONAL CHIEF SECRETARY AND CHAIRMAN, AGRF OF THE MEETING HELD ON 12.8.2016 ON THE ISSUE  

Respected Sir,

At the time of selling the property the builder ABW SUNCITY had promised to provide a club for which a sum of Rs. 2 lakhs plus service charge @ Rs. 12.8% amounting to Rs. 24,720.00 plus stamp duty @ 7% amounting to Rs. 14,000.00 has been charged by the Builder which actually has not been provided to us.

Shri R S Baqtth had asked the Builder to show where the club is and ABW SUNCITY gave a wrong information terming the the community centre is the club.

We had then gone in detail in explaining  the difference in the community centre and the club and had emphasised that what the builder has provided is a community centre which in any case had to be provided to us as this is the requirement of the law and this community centre has been provided out of the FAR of the owners and is not a saleable FIR

We had also explained that the Club has to be provided on a land which is not a part of the FAR of la Lagune and hence the club has to be independent of the community centre.

We had then given details of the description of the Building, as claimed by the Builder in the sale deed, and as approved by the Directorate of Town & Country Planning, Haryana vide letter No. ZP-231/JD(BS)/2013/35544 dated 5.4.2013 while granting the occupation certificate in form BR VI (under Rule-47(1) approving the Group Housing for La Laune on an area of 11.3248 acres which reads as under Annexure 1:

DESCRIPTION OF BUILDING

“Building Blocks A, B, C, D, E, F, G, H, J, K, M ( 318 dwelling units), EWS (58 dwelling units), Community building, Convenient Shopping and Basement in Group Housing Colony measuring 11.3248 acres ( licence No. 1189 to 1193 of 2006 dated 28.9.2006 and Licence No. 231 of 2007 dated 10.10.2007) in Sector – 54 Gurgaon “

Similarly the Directorate of Town & Country Planning Haryana vide Memo No ZP-231/JD(BS)/2011/3041  dated 14.3.2011 . BR III ( Se rule 44) at page 50 of Deed of Declaration against Para 17 GENERAL column (iv) while granting the approval mentions as under Annexure 2:

“The community building shall be included by you as a part of the common areas of the group housing colony while filing the declaration under the Apart owners Act and such community centre shall be for the exclusive use of the residents of this group housing colony only.”


Similarly the declaration under Section 2 and Section 11(2) of the Haryana Apartment Ownership Act, 1983 executed by M/s Uddar Gagan Properties Pvt. Lt. and others at page 9 and at page 10 reads as under Annexure 3:

That whole of the building blocks A, B, C, D, E, F, G, H, J, K, M ( consisting of 318 dwelling units), EWS (58 dwelling units), Convenient Shopping (11 shops) Community building in La Lagune Project consists of the following:

Community Building

Ground Floor: Entrance Lobby, 2 card rooms, one Table Tennis, One Billiard Room, One Gym Room, one library, one kids play, two offices room.

First Floor

One Multipurpose Hall, Open Courtyard, Solar Water Heating System

The occupation certificate approval granted vide BR III (See Rule 44) reads as under against para 17 Annexure 4:

The community building shall be included by you as a part of the common area of he group housing society while filing the declaration under the Apartment Owners Act ans such community centre centre shall be for the exclusive use of the residents of this group housing colony only.”

It is therefore amply clear that the Community Centre is from our FAR and hence it is on our property and therefore it belongs to the owners of the flats in La Lagune and it cannot be passed on to the owners of the flat terming it as a Club.

THE CLUB

The club does not find any mention in any of the approvals granted by the Directorate of Town & Country Planning, Haryana and hence there is no club in the residential complex called La Lagune.

You will, therefore appreciate Sir, that either the builder has to provide us a club or will have to return Rs. 2 lakhs plus service charge @ Rs. 12.8% amounting to Rs. 24,720.00 plus stamp duty @ 7% amounting to Rs. 14,000.00 plus interest from the day the Builder has taken the money the money from each resident.

Needless to mention that this Club has to be on a land which is not a part of the La Lagune Complex measuring 11.3248 acres but in addition to this.

This club which was to be provided by the Builder as per their brochure, a copy of which can be provided to you on demand, was to be having the following facilities:

1. cigar lounge
2. multipurpose hall/function lounge
3. with bar and
4. multi cuisine restaurant and
5. Senior citizen lounge.
6. coffee shop
7. double height Squash court with spectator lobby
8. Spa facility with lounge




We, therefore request Directions from you to the District Town & Country Planner to issue necessary orders to the Builder to Rs. 2 lakhs plus service charge @ Rs. 12.8% amounting to Rs. 24,720.00 plus stamp duty @ 7% amounting to Rs. 14,000.00 plus interest from the day the Builder has taken the money the money from each innocent flat owner.

Respected Sir,

In the AGRF meeting held on 12.8.2016, it was decided to form a committee headed by Shri R S Batth, Assistant Town & Country Planner, Gurgaon and comprising of representatives from the Builder namely ABW SUNCITY, Gurgaon and the La Lagune Apartment Owners Association and a factual report on all the twelve issues had to be given to the Deputy Commissioner, Gurgaon within a period of 30 days.

A meeting was held by the  Assistant Town & Country Planner, Gurgaon with all the members and a visit was also made by the District Town Planner, Enforcement  together with the Assistant Town & Country, Planner, Gurgaon on the site to conduct actual measurement of the La Lagune complex and to ensure that the entire of 11.3248 acres as per the records is made available to the La Lagune Apartment Owners Association  as ordered by the Deputy Commissioner in the AGRF meeting on 8.1.2016 as well as 12.8.2016.  The findings that the claim made by LLAOA was correct that certain area has been deliberately handed over by ABW SUNCITY to Vatika as per the documents submitted by Vatika to District Town Planner, Enforcement 

The minutes of the meeting are being forwarded herewith for your kind information.

We shall be extremely grateful if the same are approved and a detailed report on all the issues is sent to the Honourable Deputy Commissioner, Gurgaon.

Though,  it was ordered that a report had to be submitted to the Honourable Deputy Commissioner, Gurgaon by the Shri P Raghavendra Rao, IAS. Chairman of AGRF held on 12.8.2016 that the report had to be submitted within 30 days but in view of the different issues involved the submission of report has got delayed and we would therefore request you to kindly send the report now on priority.


Respected Sir, as you are aware I as the President have made more than 248 visits to the office of the District Town & Country Planner, Gurgaon including seven detailed inspections of the site and I feel the justice should now be given to us on all the issues immediately.

AN ILLEGAL CLUSTER OF AROUND 150 PLUS JHUGGIS ON THE GOLF COURSE ROAD IN SECTOR 54 GURGAON, BEHIND K AND M BLOCKS OF LA LAGUNE APARTMENTS, GOLF COURSE ROAD, GURGAON, IN A PLOT IN THE ILLEGAL COLONY CALLED SARASWATI KUNJ


Respected Sir,


1.  A cluster of more than 150 hutments with more than 500 slum dwellers staying therein existed and the main business of the people staying there existed BEHIND K AND M BLOCKS OF LA LAGUNE APARTMENTS, GOLF COURSE ROAD, GURGAON, IN A PLOT IN THE ILLEGAL COLONY CALLED SARASWATI KUNJ is KABAADI.

2.  The said hutments were removed by your office after regular complaints from our Association.

3.  These huts are being constructed again and the process has started during last 30 days.
4.  We requested you to kindly stop the construction of these jhuggies immediately before it turns out to be another mess, which as it is has been cleared after more than eight years of existence.

5.  Their source of water was an illegal bore well and their source of electricity is also illegal.

6.  Every morning around 0730 hours they burn lot of plastic and waste material not realising how harmful this practice is to their health, the health of we people and to the environment.
7.  Five cases of dengue have been reported in the last monsoon season from these Jhuggis and eruption of these Jhuggis would again be a cause of dengue menace during the coming monsoon. There are three major pits that have been created by the slum dwellers.

8.  Despite multiple complaints to civil agencies and the district health authorities, no action has been taken to remove the pits.

9.  Earlier over 150 families were staying in the hutments and there is no sewerage or waste disposal system in the slum.  The wastes are not only discharged on the ground thereby polluting the soil, the stagnant water also gets accumulated in pits.  These pits have become major breeding ground for dengue mosquitoes. A copy of the Press Release in the TOI recently had been sent to you earlier for your kind information.

10.     In view of what has been elaborated above, we request your kind and personal indulgence in getting us the following relief:

a.  Removal of the slum illegally constructed again without any approval from any of the Government bodies and taking necessary legal action.

b.  Stopping the owners of the property from not only making Jhuggis but also filing cases against them under the Indian Penal Code and other violations of the rules laid down by Government of Haryana.

c.  Stopping the residents from illegally drawing water from the deep bore well which still exists there illegally and constructing the Jhuggis.

d.  Stopping the residents from illegally drawing the electricity for consumption and to take necessary legal action against them for violations of the rules laid down by the electricity authorities, Government of Haryana.
e.  Stopping the residents from discharging the waste on the ground and taking necessary illegal action.
f.   Stopping the residents from flooding the pits with water resulting in breeding of dengue mosquitoes and taking necessary legal action.

11.     A copy of this application is also being marked to the concerned authorities to take necessary legal action against the owners of the property and against this illegal cluster of slum dwellers coming up in the area.
