ANOTHER MAJOR VIOLATION BEING HIGHLIGHTED HERE – ILLEGAL CONSTRUCTION IN TOWER K AND M – STILT AREA - 210.62 x 2 = 421.24 sqm without getting building plan approved.

Dear Sir,

We wish to  draw your kind attention to the violations done by M/s Udaar Gagan Properties Private Limited, Suncity Business Tower, 2ndFloor, Golf [Course Road, Sector 54, Gurgaon – 122002 against the Licence No. 1189-1193 of 2006 and 231 of 2007 and the Building Plan approved by DGTCP, Haryana through memo no. ZP-231/JD(BS)/2011 dated 14.3.2011 granted to  M/s Udaar Gagan Properties Private Limited.

MAJOR VIOLATION BEING HIGHLIGHTED HERE – ILLEGAL CONSTRUCTION IN T

I am enclosing a copy of a report of The District Town Planner, Gurgaon No. 11959 dated 28.12.2012 in respect of Licences mentioned above.  Annexure 1
You would notice from the said report at page 5 that an area of 487.61x2= 975.22 sq.mt has been achieved against the sanctioned of 273.993 x 2 = 553.986 sq.mt.  Hence 210.62 x 2 = 421.24 sqm FAR has been achieved without getting building plan approved.
As per section 3B of the Haryana Development & Regulation of Urban Area Act, 1975 ( Annexure 2 )  no personal shall erect or re-erect building in a colony save in accordance with the approved plans and subject to such restrictions and conditions as are contained in the license or as may be specified by the Government or the Director.  Thus M/s Udaar Gagan Properties Private Limited has contravened the provisions of section 3B of the Act ibid in deviation from the sanctioned building plan without any approval from the competent authority. 
Even as per para 9of the Form BR VI, the basements and stilt shall be used as per provisions of approved zoning plan and building plans Annexure III. 
In view of above they should be ordered to restore the building/land as per the approved building plan and you may kindly like to recommend to the competent authority for legal action against the company.
We would also request you to kindly ensure to advise the Sub Registrar, Department of Revenue, Gurgaon not to register the sale deed in respect of the area illegally constructed by the company.
