of handing over of the IBMS, [A1] Complex Assets, Handover Agreement and incomplete

dated 15.6.2016, 27.6.2016, 5.7.2016 and reply dated 24/6/2016 of
the licensee M/s Uddar Gagan Properties Private Limited, Gurgaon to your office
Dear
Sir,
In reply to complaint filed by us, your office was
kind enough to ask for an explanation from the Licensee M/s Uddar Gagan
Properties Private Limited on the subject issues.
The licensee vide his letter No.
CIN:U74899DL1994PTC061699 dated 24.6.2016 replied as under:
“Also the execution of handing over documents are not
required as all statutory compliance in respect thereof has been already
completed on our part and have already handed over the security deposits and
all payable monies to the Association and whatever balance amount remains to be
paid is under audit and shall be paid to the Association, accordingly after
completion of the audit” A copy of their letter mentioned above is enclosed
herewith. Annexure I.
Sir, the IBMS[A2] was handed over sometimes in 2013 and
since then as per law the balance sheet duly audited have to be submitted every
six months and hence by now the accounts of the company ought to have
been audited almost seven times.
Hence, as is visible, the company has made a wrong
statement before yourself and therefore should be instructed to:
I.
Handover the entire IBMS with interest
II.
Sign the Handover agreement
III.
Handover the entire complex of 11.3248 acres
IV.
Handover all the assets with proper purchase receipts
V.
Complete the infrastructure
I am enclosing the details of Rs. 20,24,21,542 being
the IBMS amount due from the builder as on date. Annexure II

shall be grateful for early instructions from your end.
