ILLEGAL SALE OF AROUND 800 SQUARE METER FROM OUR COMPLEX ADMEASURING
11.3248 ACRES NAMELY LA LAGUNE, GOLF COURSE ROAD, SECTOR 54, GURGAON in
the year 2007
Day light robbery by the Licensee M/S Uddar Properties Ltd Suncity
Business Tower, 2nd Floor, Golf Course Road, Sector 54, Gurgaon –
122002 and the builder M/S ABW SUNCITY and its
Directors, a partnership firm formed by M/S Aditya Buildwell
Private Limited and M/s Suncity Projects Private Limited and M/S Suncity
Projects Pvt. Ltd. having its office at Suncity Business Tower, 2ND
Floor, Sector 54, Golf Course Road, Gurgaon who have cheated the Government
by taking more FAR when actually they did not have the intention of retaining
the land against which they took the additional FAR and hence made money both
by selling the land and claiming more FAR and selling the additional FAR earned
against the sold land.
Respected Sir
You
were kind in ordering the Enforcement Directorate to conduct a joint
measurement of the LA Lagune
Complex, Golf Course Road, Sector 54, Gurgaon Licensee M/S Uddar Properties
Limited, Suncity Business Tower, 2nd Floor, Golf
Course Road, Sector 54, Gurgaon – 122002 by Enforcement Directorate, Vatika
Commercial Building- Builder M/s MVGG Builders Private Limited, Uddar
Properties Limited. and the La Lagune Residential Welfare Association.
The
shocking revelation to the Enforcement Directorate by Vatika Commercial
Building- Builder M/s MVGG Builders Private Limited through proper
documentation was as under:

1. M/S Uddar Properties Ltd Suncity Business
Tower, 2nd Floor, Golf Course Road, Sector 54, Gurgaon – 122002 Licensee of LA LAGUNE Complex, Golf Course Road,
Sector 54, Gurgaon which was developed by M/s ABW SUNCITY had sold the land to
M/s Vatika in 2007. This fact was in the knowledge M/S
ABW SUNCITY and its Directors, a partnership firm formed by
M/S Aditya Buildwell Private Limited and M/s Suncity Projects Private Limited
and M/S SUNCITY PROJECTS PVT LTD HAVING ITS OFFICE AT SUNCITY BUSINESS
TOWER, 2ND FLOOR, SECTOR 54, GOLF COURSE ROAD, GURGAON

This was done after having obtained
the License No. 1189 to 1193 of 2006 and License No. 231 of 2007 dated
10.10.2007.

This means after having availed
of the permissible FAR against a property through the permissions, an area
of 800 square meters was sold to Vatika Commercial Building- Builder M/s MVGG
Builders Private Limited.
4. By
selling the land the Licensee cheated the Government by taking more FAR when
actually they did not have the intention of retaining the land against which
they took the additional FAR and hence made money both by selling the land and
claiming more FAR and selling the additional FAR earned against the sold land.
5.
The owners of the flats were cheated
as their undivided common area has been reduced though what is mentioned in the
Deed of Declaration as the undivided common area has actually not been made
available to them and sold much before the construction was even started.
6.
The documents pertaining to the
Completion certificate were submitted with wrong information as the area being
mentioned was less by approx. 800 square meters having been sold to Vatika.
7.
The documents pertaining to the
Occupation Certificate were submitted with wrong information as the area being
mentioned was less by approx. 800 square meters having been sold to Vatika
Commercial Building- Builder M/s MVGG Builders Private Limited.
8.
The details submitted in the Deed of
Declaration were wrong as the area was sold in 2007 much before the Deed of
Declaration was submitted on 09.09.2013.
9.
Since Vatika Commercial Building-
Builder M/s MVGG Builders Private Limited has already given documents to the
Enforcement Directorate, Gurgaon personally stating that the land measuring
approx. 800 meters was sold them by M/s Uddar Properties Limited, Suncity
Business Tower, 2nd Floor, Golf Course Road, Sector 54, Gurgaon –
122002 Licensee of
LA Lagune Complex, Golf Course Road, Sector - 54, Gurgaon, Harayana
hence there is no doubt on the wrong information filled with the Directorate of
Town & Country Planning, Sector – 14, Gurgaon, Haryana repeatedly by the
licensee as per the details given above.
PRAYER
Since
M/s Vatika Commercial Building- Builder M/s MVGG Builders Private Limited has
accepted and given copies of documentary evidence of the property being sold to
them and since the property actually belongs to La Lagune Apartment Owners
Association, instructions may kindly be issued to enforcement directorate to
arrange to handover the property to us.
Necessary
legal action may kindly be taken against M/s Uddar Properties Limited and the
Builders of the property M/S ABW SUNCITY and its Directors, a
partnership firm formed by M/S Aditya Buildwell Private Limited and M/s
Suncity Projects Private Limited and M/S Suncity Projects Pvt. Ltd.
having its office at Suncity Business Tower, 2ND Floor, Sector 54,
Golf Course Road, Gurgaon for committing a fraud both the Government as well as
the owners of the flats in the complex
